Editive – Terms of Use

1. Agreement

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Editive (“we”, “us”), operated by an individual based in Poland (European Union).

By accessing or using Editive, you confirm that:

  • you are at least 18 years old or have obtained valid legal consent
  • you have the legal capacity to enter into this agreement
  • you agree to be bound by these Terms in full

If you do not agree to these Terms, you must not use the service.

2. Description of the Service

Editive provides an AI-powered text rewriting and paraphrasing tool.

The service may evolve over time and may include additional or modified features without prior notice.

3. AI Transparency Notice (EU AI Act)

Editive uses artificial intelligence to generate text.

By using the service, you acknowledge that:

  • outputs are generated by an automated system
  • outputs may be inaccurate, incomplete, or misleading
  • outputs are not verified by humans unless explicitly stated
  • outputs do not constitute professional advice of any kind

You are responsible for reviewing and validating all generated content before use.

4. No Professional Advice

The service does not provide:

  • legal advice
  • medical advice
  • financial advice
  • or any regulated professional service

Any reliance on outputs is at your own risk.

5. User Responsibilities

You are solely responsible for:

  • all content you submit (input)
  • all content generated (output)
  • how you use the service

You agree to comply with all applicable laws and regulations, including:

  • copyright and intellectual property laws
  • data protection laws (including GDPR)
  • defamation and unfair competition laws

6. Personal Data & GDPR Responsibilities

You agree that:

  • you will not submit personal data unless necessary
  • you have a lawful basis to process any personal data you input
  • you act as the data controller for any personal data submitted

We act as a data processor only where applicable.

You acknowledge that submitting sensitive or confidential data is at your own risk.

7. No Confidentiality

We do not guarantee confidentiality of any content submitted to the service.

Do not use Editive to process:

  • confidential business information
  • trade secrets
  • sensitive personal data

8. Acceptable Use

You agree not to use Editive to:

  • violate any applicable law or regulation
  • generate unlawful, harmful, or deceptive content
  • impersonate any person or entity
  • generate spam or unsolicited communications
  • harass, abuse, or harm others
  • attempt to reverse engineer or extract underlying models
  • interfere with or disrupt the service

We reserve the right to determine violations at our sole discretion.

9. Abuse Prevention

We may implement technical measures including:

  • rate limiting
  • usage caps
  • automated abuse detection

We may suspend or restrict access without notice if abuse is detected.

10. Intellectual Property

Your Input

You retain ownership of content you provide.

You represent that you have all necessary rights to use such content.

Output

You may use generated outputs freely.

However:

  • we do not guarantee originality
  • we do not guarantee non-infringement of third-party rights

Service

All rights, title, and interest in the service remain our exclusive property.

11. Service Availability

We do not guarantee that the service will be:

  • uninterrupted
  • secure
  • error-free

We may modify, suspend, or discontinue the service at any time without liability.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided:

"AS IS" and "AS AVAILABLE"

We expressly disclaim all warranties, including:

  • accuracy
  • reliability
  • fitness for a particular purpose
  • non-infringement

13. Limitation of Liability

To the maximum extent permitted by EU law:

We shall not be liable for:

  • indirect, incidental, or consequential damages
  • loss of profits, data, or business opportunities
  • decisions made based on generated outputs

Our total liability shall not exceed:

€100 or the total amount paid by you in the past 12 months, whichever is lower

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from:

  • your use of the service
  • your content
  • your violation of these Terms or applicable laws

15. Payments and Subscriptions (if applicable)

If paid features are offered:

  • all payments are final unless required otherwise by law
  • we may change pricing at any time
  • subscriptions may renew automatically unless canceled

Additional billing terms may apply.

16. Termination

We may suspend or terminate your access:

  • at any time
  • for any reason
  • without prior notice

You may stop using the service at any time.

17. Changes to the Service

We may:

  • add, remove, or modify features
  • introduce limits or restrictions

without prior notice or liability.

18. Changes to Terms

We may update these Terms at any time.

Continued use of the service constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of Poland.

Any disputes shall be resolved by the competent courts of Poland.
